Circuit Court News

On Mon., Jan., 27, both Judges heard matters in Gilmer County Circuit Court.

Five juvenile matters were heard by Judge Facemire and reset as follows: 1 for March 24 at 9:20, 2 for March 24 at 9:30 and 2 for April 28 at 9:00.

The case of State vs. Stephanie Smarr was reset for Feb., 24 at 10:30. Smarr was represented by Christina Flanigan of Buckhannon.

State vs. Casey Cottrill was before the Court for reconsideration of her former sentence. She was represented by Garth Beck of Clarksburg and she appeared by video conference from Tygart Valley Jail. Authorities there were directed to transport her to a rehab facility and upon successful completion of their program she will be appearing before the Court again for further sentencing. Facemire stressed this was her last opportunity as she had earlier been given a similar chance.

State vs. Amanda Smith was also before the Court for reconsideration. She was also represented by Garth Beck but the Judge denied her motion.

One expungment case was heard and granted with the prosecuting attorney to prepare the order.

Later, Chief Judge Jack Alsop appeared by video from the Braxton County Court House and heard a juvenile matter and scheduled it for further hearing Feb., 19 at 10 a.m.

Family Court News

On Wed., Jan. 22, Family Court Judge Larry Whited held court in Gilmer County. He continued one domestic violence case and granted one divorce.

Daniel Loftis, 34, of Burnsville, divorced Andrea Loftis, 29, of Sutton.

Gilmer County Magistrate's Court

  • On Mon., Jan. 20, Lisa A. Smarr was cited for driving suspended / revoked (Non-DUI) 3rd offence.
  • On Tues., Jan. 21, Williams C. Smith was cited for possession of marijuana with intent to deliver.

  • On Fri., Jan. 24, Stonewall Jackson Memorial Hospital sued Roger Dale Sharp for nonpayment of his account.
  • On Fri., Jan. 24, Stonewall Jackson Memorial Hospital sued Harvey W. Shackleford for nonpayment on two accounts.

Worthless Checks

On Mon., Jan. 13, Michelle L. Fisher was cited for writing a worthless check to Somerville Exxon.
